Your example is too simplistic and uses logic.

They will use the law to prove that it was this terrorists right to use freedom of movement on entering the country, but not extend it to France's case to extradite him which is probably against his human rights in their eyes.

I'd love one of these right on lefty types to be face to face with an ISIS warrior shouting "Allahu Akbar" just to see their smug faces crumple in fear and sh1t themselves having been woken up from their ideological dreamworld.

So you support the idea of the EU and federalisation. He'll be extradited to France, I have no doubt, but likely as not, he'll fight extradition on what ever grounds he can. The best case to do that on is the possibility of a fair trial.
