Incitement doesn't require a complaint, only an intent on behalf of the party.

but the question still remains - who has he incited|? and to do what?

He simply asked a woman to 'explain Brussels'

Is it now illegal to 'incite' someone to give you an answer to a random question?

He's in court today (Saturday).

I for one hope this menace is taken off the streets. We'll all be much safer thanks to the actions of the brave police.....

....state.

If I were her husband, should she have one, and she came home and told me what had just happened, trust me I would be incited. So much so I would be walking the street looking for this chap. Or, knowing where to find him, walking Selhurst Park. With my raygun.

Let me remind you he walked up to a random lone woman and appears to have been pretty threatening based upon his presumption of her religion. Is that really OK? Ah, of course, it's fine because she asked for it.

LoL. If a murder took place and the witness is the murderer(S) and the victim is dead. Did it occur?

I would say ask Stephen Lawrence.

I assume his Tw@tter feed is admissible? Not that I have that much interest in what is after all an everyday happenstance.

For me if a tw@t in the street went up to your daughter, sister, mother, grandmother and started ask weird questions (any subject), especially in front of you what would you do? I know what I would have done the damn fool.

Troll, I am not defending him, I just think this is bollocks.

People have a tendency to fib on social media, so no, I do not think his Twitter is admissible.

Your examples are claptrap. Murder - there is evidence. A body. If someone said something in front me to my family there is evidence - witnesses. Why bring Stephen Lawrence into it?

In this case there is nothing, no compliantant, no one coming forward, just social media bollocks. It appears to be a collosal waste of time and police resource.

He clearly states that he asked the question politely, so not threatening her in any way (other than making her believe that he was of the 'nutter on the bus' type that we have all encountered at some time or another).

One assumes that he identified her as muslim by her wearing a hijab or other clothing, since he was so positive that she was a muslim - not many other people wear them for fun.......

A third party being upset by a conversation between the two people involved when not actually a party to that conversation would be hard pressed to prove 'incitement' - bit like hearsay evidence is not acceptable.

Nowhere did I say or imply that she 'asked for it' - that is something that you have taken upon yourself to infer from my merely asking who had been incited to do what to whom to commit the offence with which he has been charged. So that is purely your opinion, not mine.

It also now appears that the charges have been dropped and the CPS advise that the police did not even have the legal right to charge him for the offence they did!

Doesn't matter he if he lied about it. The offence was the twitter post and probably his subsequent posts. I do agree it was a waste of time.

I have prepared one of my own time capsules. I have placed some rather large samples of dynamite, gunpowder and nitroglycerin. My time capsule is set to go off in the year 3000. It will show them what we are really like.

How is the Twitter post an offence? This is the nub of what I am trying to get at.

It appears to be a knee jerk reaction to something that is probably bollocks.

Are Tweets admissible? If I say I have twelve inch cock on Twitter, Halle Berry sees the tweet, comes to Croydon & bangs me and then discovers this is not strictly true, can she have me arrested for fraud as a result?

Probably not, but the lady from Trading Standards might enjoy investigating.......

The HOL is a bizarre place.

So what we know is that - according to him - a young man walked up to a woman passer by, choosing her because she appeared to be a Muslim.

He then asked said unknown person to explain Brussels and tweeted that she was mealy mouthed for not choosing to engage with him.

The Police, as they are prone to do, then made a huge mess of their reaction. This is the organisation that can't attract external candidates for their most senior positions by the way and suffers from all manner of institutional problems.

This site then focuses entirely on the flawed reaction of the Police.

Meanwhile there is someone out there, apparently, that was targeted because she was a Muslim. And that almost certainly was sh*ting herself given she was a lone woman and Muslims generally are probably feeling pretty scared of a backlash. People on this site say that is nothing special, just a normal day in Croydon. And in his own words he wasn't threatening - I am sure he is a good judge of that given how good a light he has shown himself in with his other tweets.

There has been little real opprobrium for this moron. Even though effectively he did it in your and my name. It's all over the papers that he is from Croydon and a Palace fan. Yet more negative PR that we just don't need.

In my view it's a shame nobody showed him the error of his ways, he clearly is unable to put himself in the shoes of others (at least at the pleb level) and presumably spends his life being seriously annoying.

And in a nutshell you have highlighted what is wrong with this situation - by saying that she was 'almost certainly s***ting herself' you are imagining her reaction and being offended on her behalf.

How do you know she was 'almost s***ting herself'? If this did happen, she might have taken, what in my mind is the correct response, that some gobs***e bellend has made a comment that should be swiftly rebutted and him ignored. Then she went about her business with no further fuss. That approach I admire, the 'I will deal with this with calmness and dignity' way.

And by taking the view that we are saying this is a 'normal day in Croydon' by opposing your view, you are implying that we are not sympathic to the need for understanding and calm in these difficult times. May I suggest that you get off of your divisive high horse and stopping judging those whose views differ from yours so arbitrarily?

Its the act of posting it on twitter presumably - by sharing that, I suspect the police regard him as engaging in an activity outside of free speech protection that is intended to spread 'hate'.
