All interesting stuff, but if that's his defence, they're going to increase his sentence.

Crimes are defined not so much by what the victim did, but the intentions and actions of the perpetrator. They might be mitigated by such factors. But its really a variation on the 'asking for it' situation.

Now I do accept he could be innocent, or guilty, based on the new evidence (which no one knows). It does strike me that people seem to be 'very convinced' of his innocence.

I'm going to wait for the new evidence as none of those involved come out of the situation without question marks over their behaviour - whether legally or morally.

However, to your point above, if only the accuser says that consent didn't occur, should we automatically believe them??

It certainly does on this forum as far as away supporters sitting with the home crowd according to hundreds of posts on HOL

Well they have to prove it didn't beyond reasonable doubt, in a court of law. So there is an onus on them to prove it - and it warrants investigation.

Where as we seem to be quite accepting of the idea that the two accused had consent, based on their word, despite the alleged victim having no memory of this, along with consenting to sex with a man she never met, and engaging in a threesome.

What we know is she went back to the hotel with one of them and we can safely presume consent or it reasonable for him to believe he had consent (by way of actions).

No one, based on the evidence at the trial, can say that anyone else was responsible for the woman being in that state but herself!

Well I can understand that how we can say she agreed to go back and have sex with one of the men (McDonald) but at the original trial there is nothing that established she consented to have sex with the accused as well. Which was the crux of the original case. McDonald was established as not guilty, because it was reasonable by action for him to believe consent.

However, for the accused, that isn't established. He turned up after McDonald and the victim had returned to the hotel, seemingly after McDonald informing Evans by text, that he had brought a woman back. It also was established by the prosecution that he obtained the key through deception and let himself into the room.

My fiancée just got her degree in Forensic Science which obviously included a portion on forensic psychology.

Fascinating subject. Although, having followed your advice on the Wests, I'm quite inclined towards it being just a hobby for me.

Although a friend of mine is one of the UK's leading Forensic Archaeologists. His stories of work sound like my nightmares.

On the subject of gold digging, how much has she earned? The basis of the prosecution was interesting as it presented the case that she wasn't aware who she was with until after the event, when a third party told her after checking the video footage.

Now the new evidence might paint that in a different light. But surely if you're a gold digger you'd plan it in advance somewhat, and not rely on being picked up by a third party outside a taxi rank.

If however, she's realised after the event and made money from the story, then she's like many victims of crime across the UK, someone who's made the most of their situation. It doesn't follow that the events didn't occur.

Its astonishing how many witnesses who appeared in the trail of Rose West had sold the rights to the story (including police officers, solicitors, victims, witnesses for the defence, prosecution and victims families). She was still very guilty.

I'd have thought, gold diggers would likely want to sell the story first or blackmail the subject, and not perjure themselves in a high profile criminal case. Certainly, if I was gold digging on a rape case, I'd avoid criminal court, and go straight to civil. Easier to win, the financial compensation is higher and you can still sell the story. Plus, if you have the option of settling out of court.

But it is a fascinating, and interesting case, that could have serious repercussions if he loses his re-trial, as its sets interesting precedent.

Ched is a wrong 'un... but we have to let justice take it's course.

I have a friend who works in private healthcare, one of the lawyers who worked at the firm that defended CE, she had a bit of work done. This lady wouldn't discuss the details of the case, but she did say the evidence was far from conclusive, and in her career she has seen cases collapse/get thrown out with similar levels of evidence.

If he is innocent, the poor sod has had his life destroyed. If he is guilty, he got what he deserved.
