Yeah, these are my thoughts. When you're in a dark nightclub, have had a few beers and a dolled up girl tries it on you go there without hesitation. It's the way it is. What are we supposed to do now? ID check people before we have sex with them? Even if he had done that, he'd have been shown the fake she obviously used to get this, which trained and sober bouncers didn't spot.

Yeah this is what I thought also. I don't believe he has pleaded guilty to knowingly having sex with an underage girl.

I don't go to nightclubs. I just hit on women that look over 40 so there's no doubt.

We can't speculate too much as there is still a court case in progress for the two charges he has pleaded not guilty to. However, he has pleaded guilty to "kissing a 15-year-old schoolgirl after grooming her over the internet." and "intentionally touching the complainant in a sexual way knowing that she was under 16" which is completely different from your example. Doesn't matter, if the defendant reasonably believes that the victim was over the age of 16, that is a valid defence. It is only if the child is under 13 that you cannot use a 'I thought they were older' defence.

That he has pleaded guilty to a sexual activity charge means that defence does not come into play. It may be that he did not know the age for the other two charges, or denies them having taken place. Hard to say anymore without knowing the charges, but sexual activity can simply be 'intentional touching which is sexual'. It could include something like touching her arse which, although still criminal, would be nothing like the severity of some other charges.

He probably is claiming he was mislead. I don't know the ins and outs of grooming laws you'll be reassured to know, but as leejaneagles said texting some bird you met in a club might constitute grooming if she turned out to be underage. In which case better to admit it, but with the claim you were mislead and hope the judge is understanding. I don't know the letter of the law and can't really be arsed to find out either but this seems a logical approach to me.

Yep, those charges absolutely confirm that he was aware that she was below the age of consent so this isn't a case of 'I didn't know or reasonably
believe she was under 16'.
Looks like he will be signing for Nantes after all...

Nonce - The guilty change their plea at the last minute to reduce sentence of time, and possibly to get a suspended sentence.

Its probably a good idea to ask people their age, if they look a bit on the young side, if your say, a 27 year old man. If they lied or deceived you, then you probably haven't committed a crime. Reasonable is a key element in law.

All a bit moot, considering he admitted knowing she was under age and to an offence of grooming the girl.
