I'm not sure how it works out but a Blood Alcohol Content of 0.08 is the minimum for Driving Under the Influence (DUI)/Driving While Intoxicated (DWI). The actual charge depends on what State Law defines the violation. In New York DUI is reserved for driving stoned, i.e. narcotics, both street and prescribed. However, if you get stopped for some other violation or are involved in an accident in several states including New York, a 0.05 BAC will get you charged with Driving While Ability Impaired (DWAI or DWAI-A).

Sadly, so many people get out of DUI offences over here, get yourself a decent lawyer and they will argue your way out of it. The involuntary intoxication plea actually works more than you might think, unless the police can find witnesses to their drinking. The most bizarre defence that seems to be picking up steam in states where you have to give permission for the police officer to apply the sobriety test, is that the defendant was too drunk to legally agree to the test and thus the sobriety test becomes invalid!!! Yes, if you admit to being drunk, you can get out of the DUI. Only in America.

) that denied states federal highway money if they didn't set their BAC to 0.08 also required implied consent laws forcing drivers to submit to on the scene breathalyser testing. I know some lawyers try to argue that reliance on breathalyser testing without a supporting blood test constitutes reasonable doubt. Judging from media reports, Wambach will probably go for diversion therapy to avoid a criminal conviction.
