Oxford female student spared jail for knife attack

On face value this does very much seem like a "them and us" situation.

However on closer inspection, the girl had a number of mental issues including an eating disorder, and was unstable emotionally due to a previous damaging relationship.

Talented and bright, possibly a future life saver, what would be the point of ending that future for her, it's not her fault she's from a privileged back ground. I think the judge for once, exhibited some common sense and applied the law as he saw fit.

Was if fair ? probably not, but neither is life, get over it.

I'm not sure we should be picking our 'future life savers' from the ranks of the emotionally unstable no matter how bright.....there are other more 'reliable for others' roads for her to travel down.

I have sympathy for your last sentence.

If this kind of thinking was applied across all of society I could perhaps not be annoyed as much....but as the public discourse is dominated by claims of the need for 'equality' this kind of hypocrisy needs to be highlighted.

Given that custody should serve as deterrent, rehabilitation, and protection for the public, I can't see how an unstable personality is a mitigating factor. That seems to imply she's pretty likely to do something similar again because she's a bit of a nutter - more reason for a custodial sentence, not less

Leeds 2016:

"A teenager has been given a suspended sentence for stabbing another youth two years ago in Almondbury.

Leeds Crown Court heard Roden Bedford was only 17 when he went to a mini market in Southfield Road with his uncle David Lockwood on March 8, 2014.

While they were there his uncle became involved in a verbal confrontation with a 15-year-old youth and they began to fight."

Ah, but in three of those cases food was involved. And if someone stands between me and my next meal I can get slightly annoyed. Hangry is the correct terminology. Should really be introduced as one of the partial defences in my humble opinion

Old people also get disproportionately short sentences also.

Old, female or rich. All 3 is like a get out of jail free card.

She is Young and made a very silly mistake, are you saying that mistakes made when we are young should ruin your chances of future success ? I think Ian Wright might Disagree, or indeed Anthony Joshua. The fact is this is a pure slice of fried headline grabbing gold for those of a certain persuasion, and actually if you look into it, prison is really seen as a last resort in waaaaaayy more cases than your giving the impression of.

There are loads of cases of dangerous driving where the victim has actually been killed, and the driver has walked, one case was the mother who was found guilty of causing death by dangerous driving, but spared jail "because it would be a violation of her human rights" There was also the guy last year who ran down a couple killing them, who was finally jailed but had about 30 previous convictions for car related offences. A quick search of the internet will show this is nothing like the inequality scandal it is being out to be. Pure headline grabbing

Equality is a very easy card to play, much like racism, however as I said a quick search of the internet will show this terrible injustice is actually common place across all walks of life, Jail really seems to be the last resort for all but the most serious of crimes.

Depends on how well they respond to treatment. I had serious mental health problems in my late 20s and early 30s - but with medication I'm not really any different than anyone else. of course put that on a job application, and you'll never get a job either.

If the mitigation and circumstances are such, that the Judge believes that a prison sentence would be 'unduly harsh and not serve rehabilition' in a case where the injury was minor, then its reasonable to show caution.

Certainly, going to prison won't be the issue in terms of her career, it'll be the criminal record.

Because she's been responding well to mental health treatment, and the psychiatric reports confirm that?
