He hasn't broken any contractual agreements as long as compo is paid up. Everton won't even be in a relegation battle very soon anyway. It's quite possible he never envisaged any big cubs other than Newcastle needing his type of services so didn't expect a job offer bigger than a 30,000 stadium sized club. Everton could fill 55,000 and more.
