To be fair, Khan doesn't really get much chance to explain anything in that clip because the presenters wouldnt let him. Then the clip ended just as he was about to say something.

Not really, the human rights act has specific provision for the suspension of rights in relation to terrorism and the threat of terrorism. British citizens human rights, in relation to the British Government (or other EU states) once they leave British Soil, they're applicable in relation to the British government, anywhere in the world.

If they've committed crimes abroad, then they should be tried before a jury of their peers, like any other criminal.

Interesting phrase. Wouldn't a jury of their peers be other terrorists?

Its a legal term, from the founding basis of British Law, the magna carta. It effectively means an jury of impartial British citizens (I couldn't serve on a Jury from 1998 until 2011 because I'd worked in the court service in 1998, 1999 and 2001).
