You can cut back all the branches on your side of the fence.
I can�t see any treason why you also shouldn�t be able to dig down and cut all the roots on your side of the fence then put in a root barrier. That might also help stunt its growth.

Your right...TOP's have to be applied for and thee should be a register to check. when they are the also usually have numbered tags on them as well. Your right...TOP's have to be applied for and thee should be a register to check. when they are the also usually have numbered tags on them as well.

I wouldn't kill somebody else's tree but I would say that their behaviour is inconsiderate and is causing you inconvenience.
