Of course nobody is throwing anyone out into the freezing winter. Opinions come cheap on this site, facts seem more rare. If only there were more people that did jobs like, oh I don’t know, maybe teaching a scientific subject. They would be bound to care about researching facts before pontificating. Aero The Accelerated procedure to evict a tenant is the easiest and most suitable option for landlords, that don’t want to wait for a court hearing under Section 21, but as this is a procedure that depends on having the correct paperwork in place, if there is no existing AST then it can’t be used. All is not lost, as if a landlord wanted to evict their tenant without having an AST then they can attend a court hearing in order to explain to the judge why there isn’t an AST and why they want the tenant evicted. So yes, you probably need a solicitor. But only if the tenant refuses to leave having been served notice. Edited by Mapletree (05 Dec 2020 10.13pm)

Individuals are not charities, this is a business relationship. It is appropriate to be mindful of the needs and wishes of a tenant but it is also appropriate to give the landlord such understanding too. If not, you marginalise home rentals and push people into the arms of ‘less accommodating’ landlords.

I made it clear, evidently not clear enough, that both parties deserve fairness within this type of arrangement. However, no one had mentioned the tenant and that deserved representation. Maple made assumptions about their treatment here without any evidence for it. So sorry that when it comes to turfing people out into the street, especially those paying, that I show just the tiniest bit of concern instead of just standing up for business arrangements....which I also respect. Thanks for your views guys dont want to cause arguments .Will repeat that the Tennant was told of my plans in March and asked for his thoughts so we could suit each others plans .But he wouldn't reply or let me know his intentions. Apart from rewire and updating flat my Morgage needed to be redeemed in June 21.So effectively the council who are paying his rent and telling him to force a sec 6a could make me get repossessed because of difficulty removing him.So again he was not being forced out but was trying to be fair and helpful. So if anyone is being unfair it's the Council .Another thing I have just noticed is the Council have now seemed to have withdrawn the need for a Tennant Licence which seems odd .Thanks again guys

Councils do make it hard on purpose. I don’t blame them but it is not simple to be a good landlord

No they certainly don't make it easy .But looking after the Tennant is one think but the possibility of making the Landlord get repossessed is another .
