Any Legal Eagles out there ?

Done the Gas etc but Tennant been there 18 years and been on a rolling contract for 17 of them with one month notice either way .Now going to have to get solicitor on it as does not want to leave now although still paying rent .

If it’s an AST does longevity matter?

The thing is he has lost the original contract and so have I so does that make a difference I wonder? Questions for my solicitor I suppose.

No maple tree it probably doesn't but some legal issues might not suffice now ,but will see .

No. The process was simple. If you are using S21 then you should have an Assured Shorthold Tenancy. Serving notice is straightforward. Just follow the form 6a process rigidly.

The hard part is when a tenant doesn’t then leave. In that case you apply for a possession order and then get the bailiffs in.

If you can do some kind of deal instead that probably makes sense.

If you are looking to throw someone out into freezing weather I think at least some interest is warranted.

Tbh the poster didnt state that rent was being paid still so a bit confused. I'm sure that there must be a good reason to want the tenant out. As for throwing them out of course it is a concern but I still stand by my point of a month to month contract. Maybe the tenant knew they could use the system when the time came to be requested to leave. Covid has just enabled it to drag on longer.
Maybe waiting for a bribe to leave to get the deposit for another property. I think that's the angle one poster suggested might be the pathway to the end! Probably cheaper and quicker than the 'official' route.

Perhaps some deal can be reached.

Property rights are of course important and we all know how tenants can abuse them....well in fact everyone uses the law to advantage themselves so it's a moot point I suppose.

Both parties deserve at least a nod to fairness and as no one asked what happens to the tenent I thought it worth a mention.
