He could even say it was in airplane mode. The rule is using a communication device for personal use. He would however fall foul of the social media policy if he was saying something derogatory. That would be easy to prove.

The only distraction technique is yours as you don't like the fact that the video that image comes from A) shows that the CCTV is not as unclear as the still would suggest. B) shows there are in fact two screens for a driver to look at both perfectly clear C) that drivers seem to pick and choose where passenger safety Is applied. So stick your whataboutery, it wasn't me that posted the original image. The fact you sidetracked about point 3 in taking a photo of the CCTV screens is what I thought was whataboutery. You paint it as if the photo was taken by a driver whilst hurtling through the countryside! Your other points may be valid but I don't recall you mentioning them before. Correct me if I'm wrong. However, read back through the testimonies from drivers on here, you'll see the job of train despatch can involve much more than checking a tiny monitor. What if it's foggy? The trains are long and full. If southern can't spend some of their profit and guarantee safer journeys. They've been commissioned to run a safe public service. All Aslef and the RMT want is for their members to feel they are working to a very high safety standard. Southern want to compromise this therefore they're not fulfilling their duty as a service provider.
