If they were born a few years later they would have been but then it changed again, to only include those whose parents are Indian. What the laws are in India have no impact on what they are here. Nor does what you, or anyone else, think the laws ought to be. Someone born in the UK is British. Not an immigrant. Fact!

It has changed over the years and the original question was about 3 people born before 1950. It was asked to try to counter the fact that the accused is actually British by birth, and not an immigrant. The US wasn’t mentioned but as you have it means if this had happened there he would also not be an immigrant. Something I suspect would be more readily accepted in the US than here.
