Car accident - other driver won't admit liability.

Every collision is different. I've seen cars after a simple bump that have had thousands of £'s of damage to them, others that have had substantial collisions that have had hardly any financial damage. As for going to court, i'm amazed that for such a small financial amount this has gone anywhere near a court hearing. it'll probably get settled there and then in minutes. there will be more in fees than settlement imho.

My excess is £300 but when the body shop delivered my car back and I asked them the cost of the repair I was told it came to over £1000 , I had a courtesy car for a week and now there's legal costs on top of this. As I say my insurer were telling me to buy two new car seats and bill it to her and constantly mentioning whiplash and was I sure no one was injured. Will fight it out to get my money back as I have my husband complaining that I take the car out and now he's £300 out of pocket! Tit!

A few points here: He said / she said's - without an independent witness - are almost always split by the insurance companies, because no one will prevail in court so all arguing over it does is rack up legal bills that make each party's claim worse. Investing in a dash cam can give you an independent witness. Backing into parking spaces is much, much safer than backing out of them. Think of it this way: there's no one behind you when you're backing in...

She was cruising back without looking and seemingly deaf as a bloody post

Unfortunately, the legal wheels turn very slowly and probably on purpose so that the solicitors get maximum costs from any case. I was in serious car accident last year, and now a year down the down line we are nowhere near getting anything resolved (for reference, we were also the innocent party). As others said, without any evidence (ie. CCTV or a witness), the other party through their insurance company will deny liability. I think there used to be a phrase "Knock for Knock", where no liability can definitively be attributed. I hope it goes in your favour, but be prepared for a fight and in it for the long haul.

I had over 60 calls fishing for details of my accident, I wasn't even in the car at the time.

I don't know much about UK auto insurance. Is it "no fault," which is really "all fault?" When I lived in London in the early 1990s and had a UK license, I remember being taught to back into spaces in a car park by my instructor but I don't think the Highway Code mandates that. However, seeing as you were stopped you shouldn't be found liable for any damages but courts are funny that way. One thing that may have helped would have been to call the police so that they would write up an accident report. Where I live (New York) it is mandatory. I wish you the best of luck. Having gone through this many years ago I know how exasperating it is.

My son had a similar scenario and it got sorted pretty quick once the Court summons was issued. He pulled in to a car park space but immediately after he did so, the car in the next bay reversed out but swung round, scraping all down the near side of his car. The other driver was very apologetic and sent loads of grovelling texts that night, but when she reported the accident to insurers, she said my son had driven in to her. Once the summons got issued, her insurer didn't want to defend it because of the texts she had sent. And the area of damage to the cars. So they paid up in full without going to Court. It's not really the insurers that are the problem here. It's drivers telling lies about what happened. Edited by PA (20 May 2017 7.34am)

You dont even need to have an accident to get pestered by sundry pondlife. When you receive such calls - depending on your mood and time available - it is beneficial for the wider population to regard picking up their call as "the accident". Talking for a while about how inconvenient you find accidents will reduce their ability to annoy others.
