BBC News understands that Ezedi arrived in the UK by lorry in 2016, having travelled from Afghanistan.

His suspended prison sentence for the sexual offence, passed down at Newcastle Crown Court, included an unpaid work order.

Once that was complete in 2020, Ezedi was discharged from probation supervision.

His asylum application was twice turned down, but granted on the third occasion when he claimed to have converted to Christianity, and that being returned to Afghanistan was therefore a risk.

This case is being pointed out by some in the Home Office as an example of the frustration they have with the asylum tribunal system, that people are granted asylum despite having convictions in the UK.

Current rules mean anyone sentenced to more than two years in prison is not eligible for asylum. In 2022, this was decreased to one year.

However, those who work with asylum seekers point that you can still be at risk in your home country - and therefore a genuine refugee - even if you have a conviction in the UK.

Given the politics of some on here stunned this has only stretched to 3 pages.

By way of context, the offence committed was a "gateway" offence of the flashing variety. Still a crime, of course, and one the Tribunal should have paid closer attention to but the rules were only for 2 year plus sentences at that time; and still one year now. This would still have fallen below the threshold.

Solution: a further tinkering of the rules to ensure any offence has to be considered with convictions over one year representing deportation and ones under one year falls to Tribunal discretion. On which...

Tribunals place too much weight in favour of the applicant.

Solution: a shift in the burden of proof and re-balancing of the decision making process so it is even.

However, the real debate here has to be the conversion. Was it real, was it bogus, who knows? He came from a deeply religious background where this sort of thing is taken seriously so a genuine conversion that convinced a priest is not beyond the realms of the possible. With the Tribunal satisfied, apostacy in Afghanistan carries the death penalty and they had to grant asylum.

Solution: this is only relevant where the country of origin will persecute or kill because of the conversion. So we are talking Iran and Afghanistan where pretty much all asylum applications succeed anyway. This guy was a rare case of a rejected applicant from Afghanistan. We could have a knee-jerk reaction to completely exclude consideration, or at least give less weight to, any religious conversion. However, how can that be possible where the home country will certainly execute? There would have to be caveats.

Like I said above, this guy is going to do a very long and painful stretch for a pre-mediated act against a vulnerable female and small children. Let him rot.
