Why bother risking your life crossing the channel when you can fly here direct from your own country on a legal student visa and then claim asylum. I have some questions which I don't know the answer to. 1. When a foreign student enrols at a UK university do they pay their fees upfront and if so how much? Could a person for example pay 3 months fees say £2000 and when they get here immediately claim asylum and not do the course. In which case this is cheaper than paying a people trafficker. 2. If a person claims asylum and does the course do they still have to pay their fees or are they treated like a UK student ? Should we not make the universities liable for financially supporting these students until their asylum application is approved? 3. The article doesn't mention how many students over stay their visa, is this a common practice? And by over stay I mean they don't apply for resident permit or some other type of visa. It seems to me that whenever the government comes up with a visa scheme there are always smarter people waiting to exploit it. Much easier to accomplish this than deal with the small boats. To answer your questions, to the best of my knowledge, foreign students have to pay higher fees than home students and also are responsible for all their accommodation and living costs. They cannot avail any loan from the Student Loan Company. They would be expected to pay the first year up front, but normally in three tranches. If they drop out then the fees are still due but probably uncollected if they just return home. What would happen if they successfully claimed asylum I don’t know but suspect they would remain a debt. Foreign students are an important source of income for many universities but it looks as though greater supervision is required. With the Home Office so woefully inefficient at handling visas achieving that isn’t going to be easy.

The logical thing to do would be to ban students from claiming asylum with the threat of immediate deportation which none of the major parties would agree with and even if they did would be able to implement. They could insist that the money needed for the whole course was deposited in a ring fenced account either in the name of the student or a local sponsor in any circumstances where sufficient doubt existed. They already do this for visitor visas from certain countries. Deporting them immediately, if their country is safe, would work but as we know the current asylum system requires a thorough examination of their circumstances and changing that isn’t straightforward.
